Terms & Conditions and Enrollment Agreement

Please read these Terms & Conditions carefully prior to completing your registration. By enrolling in any course, skills session, clinic, or service provided by Blue Ridge Rescue & Safety, LLC ("Company," "we," "us," or "our"), you ("Participant," "Student," or "Client") agree to be bound by the operational, financial, and legal terms set forth below.
1. Mandatory Online Prerequisite Training & Course Access
American Red Cross Requirement: The American Red Cross (ARC) mandates that all online prerequisite learning modules for blended learning courses be completed prior to attending an in-person skills session. By regulatory and curriculum standards, students who fail to provide verifiable proof of completion cannot be admitted to the classroom and will forfeit their seat and registration fee.
Acceptable Proof of Completion: You must present an official, verifiable American Red Cross completion certificate displaying a valid QR code or verification ID upon arrival. Informal progress screenshots, module checklists, or proof from external course portals will not be accepted.
Authorized Provider Mandate: Blue Ridge Rescue & Safety, LLC is an authorized American Red Cross training provider. Course completion certificates from other certifying bodies (such as the American Heart Association) cannot be accepted to satisfy Red Cross prerequisites.
Matching Course Level: You must complete the exact online module assigned to your specific registered course. Completing a different course level (for example, completing a Basic Life Support / BLS module for an Adult & Pediatric First Aid/CPR/AED class) does not fulfill this requirement.
Third-Party Certificates: If you completed the exact, required American Red Cross online module through another licensed Red Cross provider or link, your official Red Cross digital completion certificate will be honored.
2. Strict Punctuality, Facility Constraints & Late Entry Cutoff
Fixed Facility Rental Schedules: Classroom and training facilities are secured under contracted hourly rental agreements. Sessions must start and conclude precisely on schedule; instructors cannot extend classroom hours or stay late to accommodate individual delays.
Sequential Skills & Group Scenarios: American Red Cross curriculum standards require complete, uninterrupted participation in sequential instructional blocks, paired partner drills, and collective scenario assessments from the start of class. Instructors cannot pause the group or repeat missed material.
20-Minute Hard Cutoff: Students arriving more than 20 minutes past the scheduled class start time will be denied entry to prevent disruption to on-time participants.
Fee Forfeiture for Tardy Arrival: Any student denied entry due to arriving past the 20-minute cutoff forfeits their seat and registration fee in full without eligibility for a refund or courtesy transfer. Certification will require registering and paying for a future scheduled session.
3. Cancellation, Reschedule & Refund Policy
Strict No-Refund Policy: All registrations, course purchases, and service bookings with Blue Ridge Rescue & Safety, LLC are final and non-refundable under all circumstances.
Advance Reschedule Notice (7 or More Days): If you provide written notice of cancellation at least 7 full days (168 hours) prior to your scheduled class start time, you are eligible for a one-time courtesy transfer to an open seat in another scheduled class within 90 days. If Blue Ridge Rescue & Safety does not have an open class posted within that 90-day window, your transfer window automatically extends to the next publicly scheduled date with open seat availability.
Short-Notice Changes (Between 7 Days and 72 Hours): Transfer requests submitted between 7 days and 72 hours prior to class, or any secondary reschedule requests, incur a $35 administrative transfer fee and remain subject to open seat capacity.
Late Cancellations & No-Shows (Under 72 Hours): Cancellations, date change requests, or failure to attend made less than 72 hours prior to class start are non-transferable and 100% non-refundable. At this stage, facility space, student ratios, and instructor allocations are locked.
Instructor Cancellation & Emergency Closure: If Blue Ridge Rescue & Safety, LLC must cancel a session due to instructor illness, severe weather, hazardous travel conditions, or unforeseen venue closure, students will be notified promptly via email and text message. Affected participants will receive the choice of either an immediate 100% refund of their registration fee or a priority transfer to a future scheduled class at no extra charge.
4. Billing Disputes, Chargebacks & Direct Resolution
Commitment to Direct Resolution: By completing registration, you agree to contact Blue Ridge Rescue & Safety, LLC directly at Lesley@blueridgerescuesafety.com to resolve any billing questions, scheduling conflicts, or service concerns before contacting your financial institution.
Prohibition of Circumvention Chargebacks: Because student seats are limited, facility resources are committed upon booking, and digital learning credentials are provisioned immediately, filing a credit card or bank dispute ("chargeback") claiming "Services Not Rendered," "Fraudulent Charge," or "Product Not as Described" to circumvent this published policy violates this agreement.
Representment & Evidence: Blue Ridge Rescue & Safety, LLC reserves the right to submit completed registration forms, electronic signature/checkbox logs, IP verification data, communication records, attendance logs, and this agreed policy to payment processors, merchant banks, and credit bureaus to dispute unfounded chargebacks and recover reversed funds.
5. Governing Law, Jurisdiction & Venue
Commonwealth of Virginia: These Terms & Conditions, all student registrations, and any transactions or disputes between you and Blue Ridge Rescue & Safety, LLC shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Virginia, without giving effect to conflict-of-law principles.
Exclusive Venue: Any legal action, lawsuit, or proceeding arising out of or relating to these terms, program registrations, payments, or services rendered shall be instituted exclusively in the state courts situated in Clarke County, Virginia.
Consent to Jurisdiction: By completing enrollment, participants explicitly consent to the personal jurisdiction and venue of these courts and irrevocably waive any defense or claim of an inconvenient forum.
6. Acceptance of Terms
By selecting the required agreement checkboxes during online registration, submitting payment, or attending any session hosted by Blue Ridge Rescue & Safety, LLC, you confirm that you have read, understood, and agreed to all terms, operational rules, cancellation restrictions, and legal provisions stated above.
